Cuttack, April 4: Orissa High Court today issued a ban on loud processions taken out by musical bands and stated that they have to stick to a sound limit across the state.
At the same time, police have been given a free hand to arrest violators.
The court fixed the permissive sound limit at 65 decibels, both in residential and commercial areas, and directed the home department to provide the sound “limiters” to all police stations to enable them monitor noise pollution.
A two-judge bench of Justices B.P. Das and M.M. Das was hearing a PIL on noise pollution. The bench fixed a three-month deadline for the home department to provide sound “limiters” to the police stations in Cuttack and Bhubaneswar and allowed further supply to police stations across Orissa in phases.
The court further made it mandatory for musical bands to register with the sub-collectors and take clearance from the state pollution control board before taking out a procession. “No permission shall be granted by the collector or district administration without sound limiters,” stated the court. It also asked the pollution control board and police to “control, monitor, regulate and check” that bands adhere to the 65-decibel limit.
Earlier, Orissa High Court had banned road processions by band parties after 10pm.
