GUWAHATI, April 4 – The Gauhati High Court has set aside the order of the Drugs Controller of Assam on Dr Dhaniram Baruah that had asked him to stop carrying on with his activities in his research institute. The court, however, did not express any opinion on the merit of the case of either parties, and said that it would be open for the respondents (State Government) to act in accordance with law. The court directive noted that there was “gross violation of principles of natural justice” in stopping the petitioner (Dr Baruah) to carry on activities in his research institute, as the order (dates March 11, 2008) of the Drugs Controller was issued to Dr Baruah “without putting him to any kind of notice.” “However, no opinion is expressed on the merit of the case of either party. It will be open for the respondents to act in accordance with law,” the court order said.
