The Supreme Court on Monday directed the Karnataka High Court to dispose of expeditiously the petition challenging the government order making speed governors mandatory for commercial vehicles in Karnataka.
While extending the stay on the execution of the High Court order upholding the government order, a bench of Chief Justice K G Balakrishnan, Justices Altamas Kabir and J M Panchal asked the High Court to dispose of the petition at the earliest.Karnataka government advocate Sanjay Hegde submitted that the speed governor manufacturers’ lobby was behind the PIL seeking a directive to make speed governors mandatory for commercial vehicles.
However, the petitioner’s advocate said the PIL was filed before the High Court after the petitioner lost his 27-yr-old son in an accident involving a speeding commercial vehicle.Senior advocate Soli Sorabjee submitted that accidents were increasing and uncontrolled speed of vehicles was one of the contributing factors.“There were 43,000 accidents and 7,939 deaths in the country in 2006,” Mr Sorabjee said, seeking mandatory speed governors in commercial vehicles.“In the impugned judgment, the High Court has directed that all transport vehicles which got certificate of fitness from July 1, 2007 onwards, be fitted with speed governors on or before February 11, 2008 and fresh registration would be done only after fixing speed governors. The renewal of fitness certificate also is subject to fixing speed governors,” said the petition by Mysore Rasthe Sthaliya Saraku Saganike Malikara Sangha, an association of vehicle owners. There were about seven lakh vehicles which needed speed governors on or before February 11, 2008 according to the order. “The petitioners would be put to irreparable loss and injury as very few vehicles are entitled to run in the State,” said the advocate appearing for the petitioner. The High Court had passed the order on the PIL filed by Poovaiah, seeking direction to the State to ensure that old vehicles are fitted with speed governors.
