Chandigarh, March 17 In a big sigh of relief for former Punjab Director General of Police, Punjab S S Virk and his brother Col (retd) R D S Virk, the Punjab & Haryana High Court has stayed the recommendation of cancellation of change of land use (CLU) of Chimney Heights Resort in Mohali, given by the Greater Mohali Area Development Authority (GMADA).
Granting the stay, a division bench of the High Court issued notices to the Punjab, GMADA and District Town Planner in Mohali.
The petitioner, Col (Retd) RDS Virk, brother of former Punjab DGP SS Virk, who is also a sleeping partner in Chimney Heights, had moved the court demanding stay on the proceedings in pursuance to an order passed by the GMADA on November 15, 2007.
As per the order, the GMADA had recommended cancellation of permission of CLU on the condition that there had been a short fall of Rs 50 lakh in payment of Chimney Heights. GMADA had further held that the building plans have not been submitted despite repeated reminders and copy of NOC has not been obtained from the Forest Department.
The petitioner had challenged the order and demanded stay on further proceedings in this regard. On November 29, 2004, the petitioner had got no objection certificate from the Forest Department. On May 16, 2005, the Government of Punjab, Department of Housing and Urban Development had granted permission to the petitioner allowing change of land use from industrial to recreational subject.
On February 15, 2007 a demand of Rs 2.05 crore was raised by the GMADA for the payment of change of land use charges. The petitioner had alleged that he had requested GMADA to grant him time to make the remaining payment of Rs 50 lakh, which was not allowed, and rather an order was passed recommending the cancellation of CLU of Chimney Heights on November 15, 2007.
The petitioner had further demanded directions to GMADA and Punjab government from interfering in functioning of the resort.
