Ranchi, May 9: Jharkhand High Court directed the state government to furnish an affidavit to explain if tribals in the state would be eligible for mortgaging land to procure loans.
The court, while hearing a PIL, ordered the advocate-general to seek instructions on the matter.
The case had come up after the issuance of a government circular floated by the land and revenue department, which said that all members belonging to the Scheduled Tribe (ST) would not be able to procure loans in lieu of their lands.
Felix Tamba, a local tribal, challenged the circular stating that it would affect the interests of the community.
Tamba, in his petition, said poor tribals would not be able to secure educational and housing loans by mortgaging land and this would affect the future of many tribal students and the community at large.
Tamba said the circular targets the very essence of the Indian constitution, which provides for equality to all.
Thus, the government circular is unfair legally and ought to be cancelled keeping the interest of the tribal community in mind, Tamba’s counsel argued before the court.
The matter would be taken up in court again on June 16
