Ahmedabad, May 1 A single judge bench of the Gujarat High Court on Thursday issued notice to the Gujarat government in a writ petition challenging the Jantri rates for 2008. The writ petition was filed by the Kutch Construction Industries and Rehabilitation Federation.
The Jantri is a ready-reckoner published by the state government for the valuation of property towards the payment of stamp duty.
The federation had challenged the Jantri, published on April 1, on the ground that it was made effective without following the statutory procedure. As such it is 'arbitrary, irrational and absurd,' it said.
It said in its present form, the Jantri violated the fundamental right to carry on a trade and business of the people of the region. The writ petition also contended that the draft Jantri of 2006 was kept secret till February 26, 2008, when it finally put on the website. It said the government also did not take into account the more than 3000 objections that were raised by the public within a month of the publication of the final Jantri. The petition further said that the Jantri was not effectively published, as it was only put on the Internet. The matter has been listed for an interim order on May 16.
