The All India Institute of Medical Sciences (AIIMS) has come under a shadow with the Centre contending in the Delhi High Court that the the appointment of 164 Assistant Professors and subsequent promotion of 64 of them as Associate Professors within a month of their appointment was illegal.
The government's reply came on a petition filed by a senior doctor of AIIMS, Sarman Singh, who has challenged the appointment of 164 Assistant Professors and subsequent promotion of 64 of them as Associate Professors within a month of their appointment in 2003.
An affidavit filed by the government pointed out that the promotion was made in violation of its Assessment Promotion Scheme (APS) according to which promotion can be granted only after four years of continuous service.
"The consideration of promotion to the level of associate professors was contrary to the very scheme of APS and no approval was obtained by the Centre for making such deviation of the scheme," the government said in its affidavit.
The government also referred to the findings of its five-member Karan Singh Yadav committee's report on the alleged illegal appointment and promotion in the institute which pointed out the illegality.
"The Committee was also of the view that counting of adhoc services rendered by the 64 assistant professors who were promoted to associate professors had no basis (and did not rely upon) either government rules nor any court authority," the government said.
The Centre had appointed the five-member committee in January 2007 and the report of the committee was submitted in December last year.
The High Court, on May 13, had asked the Centre to file its response on what action it took on the basis of findings of the report and directed it to place a copy of the report before the bench.
The Court had, earlier, dismissed Singh's petition questioning the petitioner's interest in the issue but it took up the case after the Supreme Court directed it to examine the matter on merit.
