Delhi HC directs removal of unauthorised construction In Vasant Kunj

The Delhi High Courthas directed the Muncipal Corporation of Delhi(MCD) to take action against all unauthorised constructions mushrooming in the D-block of Shanti Kunj area near Vasant Kunj and report it to the court by March 25.A special bench, comprising Justices A K Sikri and Rekha Sharma heard the report presented by Court Commissioner (Najafgarh zone) Sanjive Ralli regarding the building violations and unauthorised constructions in his zone.Mr Ralli's report also stated that the commercial complex situated in Sector C and pocket six and seven of Vasant Kunj have violated the building by-laws.The Court has ordered the DDA's Director (building) to be present before the court personally on March 25, to explain as to how these violations cropped up.The report of seven other court comissioners will be taken up by the Court on March 18. The Court had earlier appointed nine Court Comissioners for different zones of the capital to monitor the MCD and DDA's actions regarding the demolition of the unauthorised constructions. MCD officials had earlier submitted false affidavits in the Court showing that certain buildings were demolished when they still existed. This led to the need for the appointment of the Court Commissioners. The MCD has challenged the appointment of the Court Commissioners stating that they have no authority and jurisdiction to pass orders relating to the unauthorised constructions. The hearing on this plea of the MCD is scheduled for April 4, before the special bench.Friday, March 14, 2008
