New Delhi, Apr 25 The Delhi High Court today rejected French arms company Thales' plea to dismiss a PIL which has sought a CBI probe into its Scorpene submarine deal with the government alleging payment of kickbacks.A Bench comprising Justices T S Thakur and Siddharth Mridul said that it cannot dismiss the petition without going through the action taken report submitted by the CBI after it directed the investigating agency to conduct the preliminary inquiry."We would first go through the report and see what has been done by the CBI. If there is any ground on which the petitioner can raise objection then we would further hear it," the Bench said while posting the matter for May 16 for further hearing.Senior advocate B P Singh appearing for the French company contended that the petition should be dismissed as the CBI had complied with its order by submitting a report after conducting inquiry into the allegation of kick-backs.On the direction of the court passed on December 20, the investigating agency today filed an inquiry report in a sealed envelop before the Bench.The Court in it's order had restrained the agency to close the case after conducting the inquiry and had said that the CBI had to satisfy it that there was no evidence of payment of kickbacks in the deal.
