PATNA: The Patna High Court on Thursday issued a notice to RJD MP from Siwan Md Shahabuddin with regard to a criminal revision petition of the state government seeking recall of the evidence recorded in a Siwan sessions trial case against him as prosecution witnesses had turned hostile. The government wants the evidence recorded afresh. A single bench presided over by Justice Ghanshyam Prasad issued the notice after having heard the state government’s petition which maintained that 21 witnesses had turned hostile out of fear during the sessions trial against Shahabuddin conducted by a Fast Track Court (FTC) in Siwan. The revision petition challenged an earlier order of the FTC rejecting the petition of the state government to recall the evidence. The state revision petition added that due to the prosecution witnesses turning hostile, a dozen criminal cases against Shahabuddin had gone in his favour. In the changed situation, the evidence of the prosecution witnesses should be recorded afresh as “the earlier fear and terror of Shahabuddin would not be there” and they would be able to depose fearlessly and speak the truth before the FTC, submitted additional advocate general Ram Vilas Mahto.
