Ranchi, July 23: Jharkhand High Court today rejected claims of establishing a permanent bench of the Central Administrative Tribunal (CAT) in the capital today.
The division bench, which had reserved its order in a public interest litigation (PIL) earlier, delivered its judgment today.
The PIL was filed by one Birsa Oraon, who had contended that there should be a permanent bench of CAT in the capital. Oraon, in his petition, mentioned that the capital has a large number of cases related to CAT and a permanent bench would be effective in disposing of matters.
Oraon further mentioned that the CAT functions with a temporary bench, which is allocated cases on a roster basis. The temporary bench is constituted by the Centre and holds court periodically for a week every few months. Oraon also mentioned that judges of the temporary bench do not have a proper place to stay and have to shift from one government quarter to another.
The court, while hearing the petition, had earlier directed the Union government to file an affidavit in the matter and explain its stand. The Union government, despite several orders of the court, did not file its affidavit after which the division bench observed that it would impose a fine of Rs 25,000 if the affidavit was not filed within a week.
The Central government filed its affidavit and informed the court that there was no need to establish a permanent bench of CAT in Ranchi because of the shortage of work. The temporary bench of the CAT is enough to deal with the pressure of cases pending in the tribunal.
The tribunal has only around 125-400 cases pending, which can be easily handled by the temporary bench, the Union government said.
The court after hearing the matter at length had reserved its order in the matter. The high court rejected Oraon’s petition on the grounds that the present arrangement of CAT is enough to deal with the backlog of cases in the tribunal.
There is no need of a permanent bench as has been stated by the Central government, the court observed while rejecting the petition.
